須從夫姓 日女選擇結婚不登記

（中央社記者楊明珠東京16日專電）日本民法不承認「夫婦別姓」，也就是女性嫁人後要從夫姓，有些女性認為文件、執照等要改為從夫姓太麻煩，捨棄登記的「法律婚」，改選「事實婚」。

日本1898年明治時代制訂的民法規定，女性嫁人後要從夫姓，但部分女性認為這項規定漠視女權，組團向法院控告民法違憲，最高法院今天判決民法沒違憲。

提告代表80歲的塚本協子上個月在記者會上說：「名字對我而言，是不可讓步的，如同我的生命一樣」。她希望民法能允許女性嫁人後也能保持原姓。

日本厚生勞動省指出，去年結婚的夫婦，約96%女性從夫姓。對於是否實施夫婦選擇別姓（女不從夫姓）的制度，2012年日本內閣府的輿論調查顯示，贊成者35.6%、反對者36.4%，50歲以下的人贊成「不需從夫姓」者占多數，尤其是20多歲的年齡層，贊成者高達47%。

有些日本民眾反對「不從夫姓」的作法，認為夫婦不同姓的話，家族的一體感會消失。但支持不從夫姓的1名女性原告認為，家族的歸屬感與姓氏無關。

日媒舉1名住在橫濱市擔任獸醫的女性下村香彌子例子指出，下村結婚後在自己服務的動物醫院使用舊姓，她以舊姓名所寫的論文，很多寵物主人都知道，但獸醫的執照一定要改為戶籍名才行。

2006年她獨立自行開業，到保健所的登記、處理麻醉藥、在銀行辦事等各種手續都需有戶籍名的執照，她只好改用戶籍上從夫姓的姓。

她說，現在很多文件是用原名登記，國家考試的資格也是，處理時很困擾。

駕照、護照、銀行戶頭等都需要使用戶籍上的名字。有人為了避免原名和從夫姓以後的名字改來改去造成混亂，選擇不辦理法律上的結婚登記，即所謂的「事實婚」。

但事實婚的配偶無法成為民法規定的法定繼承人，除非遺言交代清楚。倆人對於所生的小孩，無法共同擁有親權；所得稅、贈與稅、繼承稅的配偶扣除額、減免等措施，也無法適用。

另外，有些保險公司或金融機構規定，事實婚的男女彼此無法成為壽險的受益人、房屋貸款的連帶保證人等。

1名選擇「事實婚」的女性表示，女性做不孕治療，如果是「法律婚」的話，可獲政府的不孕治療補助款，她選擇事實婚，因此每次約需30萬至40萬日圓的治療費全額自付；此外，醫療費的扣除，無法以夫婦合算方式報稅，同時她丈夫的公司知道他們是事實婚之後，也取消了家族津貼。

專攻家族法的大學教授二宮周平表示，事實婚的人被剝奪了婚姻的自由，民法有必要修法。1041216
